Only the Dutch version of these terms and conditions is legally binding. This translation is provided for information purposes.
Article 1. Applicability
- 1.1 These General Terms and Conditions (hereinafter: the Terms) apply to all offers from, orders placed with and agreements concluded with EspressoService&Repair, to the exclusion of any other general terms and conditions.
- 1.2 By using the EspressoService&Repair website, accepting an offer or placing an order, you accept the applicability of these Terms.
- 1.3 The provisions of these Terms may only be departed from in writing, in which case the remaining provisions remain in full force.
- 1.4 All rights and claims stipulated for the benefit of EspressoService&Repair in these Terms and in any further agreements are equally stipulated for the benefit of intermediaries and other third parties engaged by EspressoService&Repair.
Article 2. Offers and formation of agreements
- 2.1 All offers from EspressoService&Repair are without obligation and are made subject to the availability of the products. EspressoService&Repair further expressly reserves the right to change prices, in particular where this is necessary on the basis of (statutory) regulations.
- 2.2 An agreement is only concluded once EspressoService&Repair has accepted your order. EspressoService&Repair is entitled to refuse orders or to attach certain conditions to delivery, unless expressly stipulated otherwise. If an order is not accepted, EspressoService&Repair will communicate this within ten (10) days of receiving the order.
- 2.3 Information, images, communications given orally, by telephone or by email, and statements etc. relating to all offers and to the main characteristics of the products are given or reproduced as accurately as possible. EspressoService&Repair does not, however, guarantee that all offers and products fully correspond to the information given etc. Discrepancies cannot give rise to compensation and/or rescission.
Article 3. Prices and payments
- 3.1 The prices stated for the products offered are in euros, including VAT and excluding shipping costs, unless stated otherwise or agreed otherwise in writing.
- 3.2 Payment can be made by credit card or via e-banking. You will find more information about this on the payments page.
Article 4. Right of withdrawal
After delivery of the product, the consumer may exercise their right of withdrawal without penalty and without giving reasons. The consumer has 2 periods that must be observed.
- Period 1: Within 14 days of the day of delivery, the consumer must communicate that they wish to make use of their right of withdrawal.
- Period 2: Within 14 days after the consumer has communicated that they wish to withdraw from the agreement, they must return the ordered items.
Return address: EspressoService&Repair, Europark 2041/1, 3530 Houthalen-Helchteren, Belgium.
The consumer may choose how they wish to inform EspressoService&Repair about their right of withdrawal (email is recommended). The costs of returning the items are borne by the consumer.
If the consumer were to return an item to EspressoService&Repair damaged, opened, incomplete or without its original packaging, EspressoService&Repair may claim compensation from the consumer corresponding to the loss of value the item has undergone (see article VI.51, §2 of the Belgian Code of Economic Law).
Refunds for the items will be made within 14 days of receipt of the items. Shipping costs will only be refunded if the entire order is returned. A refund will be made using the same means of payment as the original order.
Article 5. Delivery
- 5.1 The delivery times stated by EspressoService&Repair (1-2 working days) are those given by our carriers such as Bpost, GLS, ... and we endeavour to meet them, except in cases of force majeure. Exceeding any delivery time does not entitle you to compensation.
- 5.2 A safe-place authorisation (also known as 'delivery without signature', 'left at your own risk', 'ATL – Authorised To Leave') has clear advantages in terms of convenience, but also carries significant disadvantages and risks. We advise against it. By giving a safe-place authorisation, the liability of both the carrier and ourselves lapses. This means that you are yourself responsible for any damage to or loss of the parcel.
If, for whatever reason, delivery cannot take place within 30 days, the consumer may terminate the agreement. EspressoService&Repair will then refund all amounts received.
Article 6. Retention of title
6.1 Title to delivered products only passes once you have paid everything you owe EspressoService&Repair under any agreement. The risk relating to the products, however, passes to you at the moment of delivery.
Article 7. Complaints
- 7.1 The statutory warranty is 2 years, unless a product has a shorter shelf life.
- 7.2 You are obliged to check on delivery whether the products conform to the agreement. If this is not the case, you must notify EspressoService&Repair in writing and with reasons as soon as possible and in any event within 2 months after discovery was possible.
- 7.3 If it is demonstrated that the products do not conform to the agreement, EspressoService&Repair may choose, against return of the products concerned, either to replace them with new products or to refund their invoice value.
Article 8. Warranty and liability
8.1 The statutory warranty applies.
Article 9. Force majeure
- 9.1 Without prejudice to its other rights, in the event of force majeure EspressoService&Repair has the right, at its own discretion, either to suspend performance of your order or to rescind the agreement without judicial intervention, by notifying you of this in writing and without EspressoService&Repair being liable for any compensation, unless this would be unacceptable in the given circumstances according to the standards of reasonableness and fairness.
- 9.2 Force majeure means any shortcoming that cannot be attributed to EspressoService&Repair, because it is not due to its fault and is not for its account under the law, a legal act or generally accepted views.
Article 10. Orders/communication
10.1 EspressoService&Repair is not liable for misunderstandings, corruption, delays or the improper transmission of orders and communications as a result of the use of the internet or any other means of communication between you and EspressoService&Repair, or between EspressoService&Repair and third parties, insofar as this relates to the relationship between you and EspressoService&Repair, unless and to the extent that there is intent or gross negligence on the part of EspressoService&Repair.
Article 11. Applicable law and competent court
- 11.1 Belgian law applies exclusively to all rights, obligations, offers, orders and agreements to which these Terms apply, as well as to these Terms.
- 11.2 All disputes between the parties will be submitted exclusively to the competent court in Belgium.
